These Terms of Service (“Terms”) govern your access to and use of the Imagix Crystal Ball device, mobile application (“App”), website, and related services (together, the “Services”). By using the Services, you (“you,” “your,” “parent/guardian”) agree to these Terms on behalf of yourself and your child user(s).

If you do not agree to these Terms, do not use our Services.

1. Eligibility & Parental Consent

  • The Services are designed for children ages 6 and up.

  • A parent or guardian must create the account, provide consent, and supervise use.

  • By creating an account, you confirm you are the parent/guardian of the child user and agree to these Terms on their behalf.

2. Account & Registration

  • To use the Services, parents must register an account with accurate information.

  • Parents are responsible for maintaining account security, including email and password.

  • Children should only access the child-facing portions of the Services.

3. Use of the Services

  • The Services are for personal, non-commercial use only.

  • You may not:

    • Reverse-engineer, copy, or modify the hardware/software.

    • Circumvent parental controls or safety features.

    • Use the Services in a way that violates laws or harms others.

  • All content (characters, animations, dialogue, stories, software) remains the property of Artificial Imagery Products LLC and its licensors.

4. In-App Content & Purchases

  • Parents may purchase additional downloadable content (DLC), seasonal packs, or features.

  • All purchases are processed through Apple App Store, Google Play, or other authorized channels.

  • Purchases are non-refundable, except as required by applicable law.

  • Parents agree to supervise device use in safe environments.

  • The Services include voice interaction and AI-powered features; while filtered, no system is perfect.

  • We may update safety features and parental controls over time.

7. Updates & Changes

  • We may provide over-the-air (OTA) updates for new stories, features, or fixes.

  • Some updates may be required for continued use.

  • We may update these Terms; material changes will be notified via email or in-app.

8. Termination

  • We reserve the right to suspend or terminate access if:

    • Terms are violated.

    • The Services are misused or tampered with.

  • Parents may terminate their account at any time via support.

9. Disclaimers

  • The Services are provided “as is” and “as available” without warranties of any kind.

  • We do not guarantee uninterrupted or error-free operation.

  • To the fullest extent permitted by law, we disclaim liability for indirect or incidental damages.

10. Limitation of Liability

  • Artificial Imagery Products LLC is not liable for:

    • Losses due to misuse of the Services.

    • Content created or shared by users.

    • Damages beyond the amount you paid for the Services in the past 6 months.

11. Governing Law

  • These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles.

  • Any disputes shall be resolved in courts located in Delaware, unless otherwise required by local consumer law.
