Scope
This policy covers two contexts:

Website & Store (Shopify‑powered DTC) — browsing, marketing, checkout, fulfillment.

Imagix Products — the Imagix Crystal Ball device and the Imagix Portal (companion) app.
If this policy conflicts with our Terms of Service, this policy controls for privacy topics.
1) Website & Store (Shopify‑Powered DTC)
Who operates the Store
Artificial Imagery Products, LLC (“Imagix”) operates the site and store. Shopify hosts and powers ecommerce. Shopify also processes some data as an independent controller for its own features.
Personal information we collect

Contact & account: name, email, phone, billing and shipping addresses, account login.

Order & payment: items viewed, cart, wishlist, purchases, returns, payment method and confirmation. Card data is handled by payment processors; we do not store full card numbers.

Device & usage: IP address, browser, device identifiers, pages viewed, clicks, referring/exit pages.

Communications: messages you send to support or via forms.

How we use it

Disclosures
We disclose personal information to:

Shopify and other vendors that support ecommerce, hosting, payments, customer service, analytics, and shipping.

Relationship with Shopify
Shopify collects and processes data to operate and improve the platform. For those uses, Shopify is responsible for responding to privacy rights requests. See the Shopify Consumer Privacy Policy and Shopify Privacy Portal.
Cookies and similar technologies
We use cookies, pixels, and SDKs for core site functions, analytics, and ads. You can manage preferences in our cookie banner, your browser, and via platform tools.
Children’s data (Store)
The Store is not intended for children. We do not knowingly collect personal information from children on the Store.
2) Imagix Products (Crystal Ball Device + Portal App)
Summary of what we collect
We collect only what is needed to deliver a safe, parent‑supervised play experience.

Parent/guardian account: name, email, password hash, settings, consent records.

Child profile: first name or nickname, approximate age, optional favorites (e.g., color, animal).

Gameplay & app activity: progress, achievements, in‑app selections, device/app session events.

Device diagnostics: device model, OS/firmware version, crash and connectivity logs.

Audio & voice:

Real‑time speech recognition enables natural conversations with characters such as Ellie and Ember.

Audio recordings may be temporarily stored for diagnostics and troubleshooting.

Voice‑to‑text transcripts are securely stored for diagnostics and Parent Control so parents can view recent conversation history.

No analytics, no ads, no model training: audio and transcripts are not used for analytics, advertising, or product‑training purposes.

Parents can delete conversation history at any time.

Region and location

We may detect approximate location from IP to route to the nearest server, set language defaults, and improve responsiveness.

We do not use GPS, Wi‑Fi triangulation, or mobile sensors for precise location.

Region is approximate (ex. New York), used only for technical routing, not stored in the child profile, not used for marketing, and not shared with third parties.

Region selection is automatic and cannot be manually overridden in the app.
How we use product data

Provide, secure, and improve device and app functionality.

Personalize experiences within parent‑approved bounds using profile preferences and gameplay state.

Provide Parent Control features, including conversation history access and profile management.

Troubleshoot and maintain performance and safety.
Parental controls and rights (products)
Parents/guardians control a child’s data. They can:

Review or delete the child’s profile and conversation history.
-
Withdraw consent; this stops further collection and triggers deletion.

Request access, correction, or deletion: support@artificial-imagery.com. Verified requests are processed within seven business days.
Data retention (products)

Audio recordings: up to 30 days for diagnostics, then deleted; deleted sooner if a parent deletes the profile/account.

Transcripts: up to 90 days for diagnostics and Parent Control, then deleted; deleted sooner on profile/account deletion.

Gameplay data: kept while the child profile is active; deleted at profile/account deletion.

Child profile data: kept while the account is active; deleted at account/profile deletion.

Parent account data: kept for authentication and consent while the account is active; deleted within 30 days after closure.

Device diagnostics: rolling 90 days then auto‑purged.

Consent records: retained 5 years after consent or account deletion.
Children’s privacy and consent

We obtain verifiable parental consent before activating child features.

We follow COPPA and applicable child‑privacy laws.
-
We do not “sell” or “share” the personal information of users under 16 as defined by applicable law.

We participate in the PRIVO Kids Privacy Assured COPPA Safe Harbor program.

Parents can contact support@artificial-imagery.com for any child‑data request.
3) Your rights and choices
Your options depend on where you live. We will verify your identity and respond as the law requires. You may use an authorized agent where permitted.
Access / Know. Request a copy of personal information we hold.
Delete. Ask us to delete personal information, subject to legal exceptions.
Correct. Ask us to fix inaccurate information.
Portability. Receive a portable copy where required.
Opt out of “sale”/“sharing”/targeted advertising (Store). Use our “Do Not Sell or Share My Personal Information” link and cookie preferences. We honor Global Privacy Control (GPC) on the browser that sends it. Other “Do Not Track” signals are not recognized.
Marketing preferences. Unsubscribe from promotional emails via the email footer; we may still send transactional messages.
How to exercise: use links on the Services or email info@artificial-imagery.com (Store/general) or support@artificial-imagery.com (product/child data). For Shopify‑controlled processing, use the Shopify Privacy Portal.
Appeals: If we deny your request, you may appeal by replying to our decision email. You may also contact your local data‑protection authority.
We will not discriminate against you for exercising your rights.
4) Security and retention
We use technical and organizational safeguards, including encryption in transit and at rest, access controls, and regular reviews. No method is perfect; do not send sensitive information to us over insecure channels. We retain data only as long as needed to provide the Services, meet legal obligations, resolve disputes, and enforce agreements. Product‑specific retention schedules appear above.
5) International transfers
We may process and store data outside your country. For transfers from the EEA/UK, we rely on the European Commission’s Standard Contractual Clauses or the UK equivalents, unless an adequacy decision applies.
6) Region‑specific disclosures
California (CPRA) and certain U.S. states. We disclose the categories of personal information listed in Sections 1–2 for the purposes described there to vendors and partners as described. For Store‑related advertising uses, some disclosures may be considered a “sale” or “sharing” under state law; use our “Do Not Sell or Share” link and cookie controls to opt out. Sensitive personal information is not used for additional purposes without consent. You may submit rights requests as described in Section 3.
EU/EEA and UK (GDPR).

Lawful bases: parental consent for child data; contract for order fulfillment; legitimate interests for security and non‑personal diagnostics; legal obligation where required.

7) Third‑party sites
Our Services may link to third‑party sites. Their terms and privacy policies govern those sites. We are not responsible for their practices.
8) Changes
We may update this policy. We will post changes here, update the “Last updated” date, and provide additional notice as required.
