IMAGIX — LIMITED WARRANTY

Applies to: “Imagix” hardware and included accessories
This Limited Warranty (“Warranty”) is offered by Artificial Imagery Products (“Imagix”, “we”, “us”, or “our”). It covers new, genuine Imagix-branded hardware purchased directly from Imagix or an authorized reseller, under normal household use and according to Imagix’s published guidelines (user manual, safety sheets, and service communications).
This Warranty does not replace or limit any non‑waivable consumer rights you have under the laws of your province/territory/canton/country. Where local law gives you additional rights, those rights apply (details for Canada and Switzerland appear below).
1) Warranty Period & Who’s Covered
- Duration: One (1) year from the date the original end‑user purchaser received the product.
- Coverage: The original purchaser (including a gift recipient with a valid gift receipt).
- Transfer: Non‑transferable except where local law requires otherwise.
For Canada and Switzerland, see Section 8 for important local rights that apply in addition to this Warranty.
2) What’s Covered
Defects in materials and workmanship that arise under normal use consistent with our published guidelines.
3) What’s Not Covered
This Warranty doesn’t cover, for example:
- Wear and tear, cosmetic damage (scratches, dents), or consumables (e.g., batteries or power adapters) unless failure is due to a defect in materials or workmanship.
- Accident, misuse, abuse, drops, liquid contact, fire, power surges, or use with non‑Imagix accessories.
- Unauthorized repairs or modifications, tampering, or if serial numbers are removed or defaced.
- Software, downloadable content, or third‑party services (see Terms of Service); we do not warrant uninterrupted, error‑free operation.
- Data loss or costs to recover or reinstall third‑party software/data.
- Products not sold by Imagix or an authorized reseller, or marked “sample”, “as is”, “open box”, or “refurbished” unless explicitly warranted by Imagix.
4) Our Remedies
If a valid claim is made within the Warranty Period, Imagix will, at its option:
- Repair the product with new or equivalent-to-new parts; or
- Replace it with a new or equivalent-to-new product of equal or better functionality; or
- Refund the purchase price if a repair or replacement is not commercially reasonable (including early “dead‑on‑arrival” cases verified within your standard return window).
Any replacement item becomes your property, and the replaced item becomes Imagix’s property. Repaired/replacement products are warranted for the longer of (a) the remainder of the original Warranty Period or (b) 90 days.
Remedies may be adjusted if local law requires different or additional remedies (see Section 8).
5) How to Get Warranty Service
- Contact Imagix Support: support@artificial-imagery.com
- Provide: name, email, proof of purchase, product serial number, a description of the issue, and your return address.
- We’ll troubleshoot and, if eligible, issue instructions and a return label (availability of prepaid labels may vary by location).
- Package carefully with all included accessories. Imagix may refuse service for items damaged in transit due to improper packing.
6) Limitation of Liability (to the extent allowed by law)
To the maximum extent permitted by applicable law, Imagix’s total liability for claims under this Warranty is limited to the amount you paid for the product. Imagix will not be responsible for indirect, incidental, special, or consequential damages (e.g., loss of data, loss of use), except where such limits are not allowed by local consumer law. (In Canada and Switzerland, certain rights cannot be waived—see Section 8.)
7) Relationship to Local Consumer Law
This Warranty gives you specific rights. You may have other rights that vary by province/territory/canton/country. Where local law prohibits limitations or offers additional protections (e.g., implied conditions of quality/fitness or legal warranties), those rights remain in force.
8) Country‑Specific Addenda
8A) Canada (including Québec)
Your statutory rights remain in force. Canadian consumer‑protection statutes and provincial Sale of Goods Acts imply conditions/warranties (e.g., merchantable/reasonable quality, fitness for purpose, durability) and these cannot be excluded or waived in many consumer sales. This Imagix Warranty is in addition to those rights.
Ontario example (No Waiver Rule): Ontario’s Consumer Protection Act says consumer rights apply despite any agreement or waiver to the contrary (s. 7). Similar “no‑waiver” or durability/quality protections exist across Canada.
Québec (Legal Warranty / Garantie légale): For purchases by Québec consumers, this Warranty is a “garantie conventionnelle” and does not exclude, limit, or reduce the legal warranty provided by the Civil Code of Québec (arts. 1726–1730) and the Consumer Protection Act (including ss. 38–40, which speak to durability). You benefit from protection against latent defects and goods must be usable for a reasonable length of time, considering price, contract terms, and conditions of use.
Parts & Repair Availability (Québec): Recent CPA updates strengthen expectations around the availability of replacement parts and repair information for goods that require maintenance. Imagix will comply with these obligations where they apply.
How it works in practice (Canada):
- You may choose to exercise your statutory rights with the seller (if purchased from a retailer) or request service from Imagix under this Warranty (if the product is Imagix‑branded).
- If a conflict arises between this Warranty and non‑waivable rights under provincial/territorial law, your statutory rights prevail.
8B) Switzerland
Statutory (legal) warranty period: Swiss law provides a two‑year period for legal warranty claims on movable consumer goods from delivery. For new goods sold to consumers, this two‑year period cannot be shortened in the seller’s terms. For used goods, it may be reduced to no less than one year if expressly agreed. This Imagix Warranty is in addition to those legal rights.
Remedies & contract terms: Under Swiss law, the seller is generally liable for defects (arts. 197 ff. CO). Sellers may structure remedies (e.g., repair‑only) in their terms, provided the terms are clear and do not unlawfully restrict mandatory rights. Fraudulent concealment voids any disclaimer. When you buy from Imagix directly (our website), we are the seller and we’ll honor both your legal warranty rights and this Imagix Warranty.
Defect notice: Swiss law expects buyers to notify the seller without delay after discovering a defect; please contact Imagix Support as soon as you notice an issue so we can help quickly.
Language of instructions: Where applicable, operating instructions and certain warnings must be provided in the official language(s) of the region of sale/use. Imagix will supply legally required instructions/warnings in German/French/Italian as appropriate.

10) Governing Terms
If you purchased directly from Imagix in the U.S., your agreement with Imagix is governed by New York law without prejudice to non‑waivable consumer protections where you live. For purchases in Canada or Switzerland, your local mandatory consumer law applies in addition to this Warranty.

- Québec: You must call out the legal warranty (garantie légale) and say your conventional warranty does not reduce rights under CCQ 1726–1730 and CPA (durability).
- Switzerland: Legal warranty claims on new consumer goods last two years from delivery and cannot be shortened; your terms can structure remedies (e.g., repair/replace first) but should not conflict with the statutory framework.
